Bay Area Water Heater Law 2027: Quick Summary

If you only have a minute, here’s what every Bay Area homeowner should know:

  • The law takes effect January 1, 2027
  • It applies to natural gas–fired storage tank water heaters
  • Covered units must emit 0 nanograms of NOx per joule of heat output
  • The law applies to units 75,000 BTU/hour or less
  • Existing water heaters are not affected
  • Water heaters installed in 2026 are not affected
  • Repairs and maintenance are still allowed
  • Mobile home water heaters are exempt
  • After the cutoff, only compliant, zero NOx models can be sold or installed
  • Planning ahead can mean more equipment choices, better pricing, and fewer surprises

What Is the Bay Area Zero NOx Water Heater Law?

This regulation is part of the Bay Area Air Quality Management District’s broader effort to reduce nitrogen oxide (NOx) emissions that contribute to smog and poor air quality across the region.
Under 9-6-301.5:

“No person shall sell, install, or offer for sale within the District any natural gasfired storage tank water heater that is manufactured after January 1, 2027, with a rated heat input rating of 75,000 BTU/hour or less, that emits more than 0 nanograms of nitrogen oxides (calculated as NO2) per joule of heat output. This subsection shall not apply to mobile home water heaters.”

This is an equipment emissions standard, not a usage restriction, and not a requirement to replace systems that are already in service prior to January 1st, 2027.

What Is NOx, and Why Does It Matter?

NOx, or nitrogen oxides, are gases created when natural gas burns. In dense urban regions like the Bay Area, NOx emissions contribute to:

  • Smog and ground-level ozone
  • Poor air quality
  • Increased respiratory problems, including asthma

A zero NOx water heater uses advanced burner or electric hybrid technology that eliminates NOx emissions entirely at the point of use, while still delivering reliable hot water for everyday needs.

What This Means for Bay Area Homeowners

The easiest way to understand the new rule is to separate what’s changing from what’s staying the same, especially when it comes to timing.

What Has Changed

  • Starting in 2027, replacement options will look different when your current tank water heater reaches the end of its life.
  • Standard atmospheric gas tank heaters will no longer be available for installation after the effective date
  • Only zero NOx–compliant storage tank water heaters can be installed moving forward
  • Certain models may require updated venting, electric connections, or installation planning

The key point is that you still have options today, and those options will simply shift once the new emissions standards are fully in effect.

What Hasn’t Changed

  • If your current water heater is working safely, you do not need to replace it
  • Repairs and routine maintenance are still allowed
  • The law only applies to storage tank water heaters
  • Other gas appliances, such as furnaces, stoves, dryers, or fireplaces, are not included in the new regulations

What Should You Do Now?

You do not need to panic, but you should know where your current system stands.

Step 1: Check the Age of Your Equipment

A good starting point is the age of your furnace or water heater.

Common planning benchmarks:

  • Furnace: 10–12 years old or older
  • Water heater: 8–12 years old or older
  • Age is not the only factor, but it helps you decide whether it is time to start planning.

Step 2: Watch for Signs of Decline

Your system may be telling you it is nearing the end of its service life.

Common warning signs include:

  • Frequent repairs
  • Higher utility bills
  • Inconsistent heating
  • Water heater leaks
  • Running out of hot water
  • Strange noises
  • Rust or corrosion
  • Yellow burner flame
  • Trouble keeping the home comfortable
  • Equipment that struggles during peak use
  • If you are seeing these problems, a system assessment can help you decide whether repair or replacement makes more sense.

Step 3: Decide Your Timeline

Replacing equipment before it fails can give you more control.

You may want to compare:

  • Replacing now
  • Waiting until the current system fails
  • Planning for a future upgrade
  • Comparing compliant gas options
  • Exploring heat pump water heaters
  • Considering heat pump systems for heating and cooling
  • A planned replacement usually gives you more time to review equipment, rebates, financing, and installation requirements.

Mobile home water heaters are exempt from this regulation

How We Help Bay Area Homeowners Prepare

As the 2027 deadline approaches, many Bay Area homeowners are choosing to plan ahead rather than wait for an unexpected breakdown.
Our licensed technicians can:

  • Inspect your current water heater and estimate remaining lifespan
  • Discuss replacement options available before and after the 2027 cutoff
  • Help you understand installation requirements and costs
  • Identify available incentives, rebates, or financing where applicable
  • Build a plan that fits your timeline instead of forcing a last minute decision

If your system was installed prior to January 1st, 2027 and is in good condition, we’ll tell you. If it’s nearing retirement age, we’ll help you weigh your options and plan accordingly.

Zero-NOx Water Heater Law FAQ

  • The Bay Area is a big place, which areas will be affected?

The regulation will apply to all of Napa, Contra Costa, Alameda, Santa Clara, San Mateo, San Francisco, and Marin counties, and parts of Sonoma and Solano counties. See more details here.

  • Is the Bay Area banning gas water heaters in 2027?

No. Natural gas storage tank water heaters are still allowed. After January 1, 2027, newly manufactured units must meet the zero‑NOx emission standard.

  • Do I have to replace my water heater in 2027?

No. Existing water heaters can remain in service.

  • What happens if my water heater fails after January 2027?

Your replacement will need to be a zero‑NOx–compliant model. Homeowners who plan ahead may find the process smoother and less stressful.

  • Are tankless water heaters included?

This specific law applies to natural gas–fired storage tank water heaters rated at 75,000 BTU/hour or less.

  • Are mobile homes affected?

No. Mobile home water heaters are explicitly exempt from this law.

  • Can I install a tank water heater before January 2027?

Yes! As long as the system is installed prior to January 2027, you can still install tank water heaters before the regulation takes effect.

  • When should I proactively upgrade?

If your current water heater is over a decade old, it is nearing the end of its life. Replacing it now allows you to plan the installation rather than reacting to a sudden leak or failure.

If your tank water heater is less than 10 years old, but you are not quite ready to transition to a heat pump system, there is still a window to install another standard tank water heater before the end of the year, allowing you more time to plan your long‑term upgrade.

Jazz is on the ball!! Next day service and on time, their technician Said Godinez was ready to jump right in and assess the situation…. He was knowledgeable and articulate and made our problem easy to understand with assurance that he could and would effect the repair with parts he had in the truck. The whole process was fast and easy, and our air conditioner was up and running in less than an hour. A special thanks to Said for a job well done with a smile and pleasant personality, a real bonus… This is the second time I’ve had Jazz come out, assess and repair and I would call them again and highly recommend them to anyone who wants fast efficient service with pleasant people who know what they’re doing…
