What Is the Bay Area Zero NOx Water Heater Law?
This regulation is part of the Bay Area Air Quality Management District’s broader effort to reduce nitrogen oxide (NOx) emissions that contribute to smog and poor air quality across the region.
Under 9-6-301.5:
“No person shall sell, install, or offer for sale within the District any natural gasfired storage tank water heater that is manufactured after January 1, 2027, with a rated heat input rating of 75,000 BTU/hour or less, that emits more than 0 nanograms of nitrogen oxides (calculated as NO2) per joule of heat output. This subsection shall not apply to mobile home water heaters.”
This is an equipment emissions standard, not a usage restriction, and not a requirement to replace systems that are already in service prior to January 1st, 2027.
What Is NOx, and Why Does It Matter?
NOx, or nitrogen oxides, are gases created when natural gas burns. In dense urban regions like the Bay Area, NOx emissions contribute to:
- Smog and ground-level ozone
- Poor air quality
- Increased respiratory problems, including asthma
A zero NOx water heater uses advanced burner or electric hybrid technology that eliminates NOx emissions entirely at the point of use, while still delivering reliable hot water for everyday needs.

What Has Changed
- Starting in 2027, replacement options will look different when your current tank water heater reaches the end of its life.
